Bonds Ellis Eppich Schafer Jones LLP wins $1.1 million dollar appeal

On May 11, 2023, Matt Stayton and Jared Hendrix obtained affirmance of a $1.1 million dollar breach of fiduciary duty and legal malpractice judgment at the Second Court of Appeals in Fort Worth, Texas, on behalf of firm clients ACCP, LP and Bernardo and Shannon Pana.  The Appellants urged due process violations based on deemed admissions and death penalty sanctions.  The appellate court, however, disagreed and held the trial court did not err because it afforded the Appellants a full trial on the merits and Appellants did not move to strike the admissions prior to trial.  Appellees were represented at trial by Rickey Brantley and Alex Pelley.  The opinion is styled Evangelista-Ysasaga v. Pana, No. 02-21-00271-CV, 2023 Tex. App. LEXIS 3220 (Tex. App.—Fort Worth, May 11, 2023).
